Terms and Conditions

Listify provides real estate professionals with property intelligence, predictive seller scoring, property-record aggregation, market and lead identification, alerts, workflow tools, and AI-assisted communication drafting. Features may change, be added, or be discontinued.

• Listify provides organized property insights derived from public records and third-party data sources. Listify is not a bulk raw-data broker.
• Users may not scrape, bulk-download, redistribute, resell, or use the Services to create a competing database except as expressly permitted in writing.
• Sell Probability Scores, property values, equity estimates, seller-likelihood indicators, AI outputs, and other predictions are estimates for informational and prospecting purposes only.
• These outputs are not appraisals, official valuations, tax determinations, legal advice, financial advice, or guarantees that a property will be listed or sold.
• Listify does not guarantee the accuracy, completeness, timeliness, or availability of third-party data.

AI-generated content is probabilistic and may be incomplete or inaccurate. Users must review AI-generated outreach and property insights before relying on or sending them. Users are responsible for determining whether communications are appropriate, accurate, lawful, and consistent with their professional obligations.

Listify may provide tools to draft, manage, or facilitate SMS, email, and other outreach. Listify does not authorize users to send unlawful or unsolicited communications.

• You are responsible for obtaining all legally required consent before sending messages and for complying with applicable federal, state, and local laws, including the TCPA, Telemarketing Sales Rule, CAN-SPAM, applicable Do-Not-Call requirements, and state privacy, telemarketing, and messaging laws.
• You must honor STOP, UNSUBSCRIBE, HELP, do-not-contact requests, and other applicable opt-out requests promptly.
• You must maintain accurate records of consent where required and must not upload or use contact information in violation of applicable law or third-party data-provider restrictions.
• You must not use Listify for unlawful harassment, deceptive practices, spam, discrimination, redlining, predatory conduct, or other prohibited activity.
• Listify may suspend messaging functionality or an account when it reasonably believes messaging activity creates legal, carrier, provider, security, or abuse risk.

Users may not use Listify's analytics, segmentation, scoring, targeting, or outreach features for unlawful housing discrimination, redlining, steering, or other prohibited conduct under the Fair Housing Act or applicable state or local fair-housing laws. Users are responsible for their own professional licensing and ethical obligations.

Where a user separately opts in to Listify SMS messaging, the SMS program may include account notifications, waitlist and product updates, personalized property recommendations, lead alerts, and related Listify service messages. Message frequency varies. Message and data rates may apply. SMS consent is optional and is not a condition of purchasing Listify or using unrelated Platform functionality.

To stop receiving Listify SMS messages, reply STOP or UNSUBSCRIBE. For help, reply HELP or contact support@listify.ai. Carriers are not liable for delayed or undelivered messages.

SMS CONSENT IS SEPARATE FROM ACCEPTANCE OF THESE TERMS AND THE PRIVACY POLICY.

You are responsible for maintaining accurate account information and protecting your credentials. You must notify Listify promptly of unauthorized access or suspected compromise.

Subscriptions may be billed monthly or annually as shown at purchase. Unless otherwise stated, subscriptions automatically renew until cancelled. You may cancel through available account controls or by contacting Listify. Fees are non-refundable except where required by law or expressly stated otherwise.

Listify and its licensors own the Services, software, models, interfaces, designs, trademarks, branding, and other proprietary materials. Subject to these Terms and payment of applicable fees, Listify grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for internal professional purposes.

• Scraping, bulk extraction, resale, or unauthorized redistribution of data.
• Circumventing access controls or security features.
• Using the Services to send unlawful, deceptive, abusive, or unsolicited communications.
• Using the Services to discriminate or violate fair-housing laws.
• Attempting to reverse engineer proprietary models or systems except where prohibited by law.
• Using the Services in a way that violates third-party data-provider terms or applicable law.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. LISTIFY DOES NOT WARRANT THAT DATA, SCORES, AI OUTPUTS, OR SERVICES WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, OR ERROR-FREE. USERS REMAIN RESPONSIBLE FOR INDEPENDENTLY VERIFYING MATERIAL INFORMATION BEFORE MAKING BUSINESS OR PROFESSIONAL DECISIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTIFY AND ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM THE SERVICES. LISTIFY'S AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICES WILL NOT EXCEED THE FEES YOU PAID TO LISTIFY FOR THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, except where a greater limitation is prohibited by law.

Listify may suspend or terminate access for material breach, unlawful or abusive use, nonpayment, security risk, or activity that could expose Listify or its providers to legal or carrier sanctions. Provisions that by their nature should survive termination will survive.

These Terms are governed by Delaware law, without regard to conflict-of-law principles, unless applicable law requires otherwise. Any permitted legal proceeding will be brought in the applicable state or federal courts located in Delaware, subject to mandatory consumer or statutory rights.

Listify may update these Terms from time to time. Material changes will be communicated as required by law. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
